Knowing Your Rights
Workers Compensation claims fall into two general categories: accidental injuries which occur on the job, and occupational diseases which are illnesses caused by the kind of work you do. Both of these types of claims may result in permanent injuries.
For injuries that involve head, neck, back, lungs, strokes and heart attacks you may be entitled to lifetime weekly payments, if you are unable to work or suffer a loss in your weekly salary due to these injuries. For injuries involving the extremities including the fingers, toes, hands, arms, legs, ears and eyes a worker may be entitled to a monetary "schedule loss award", even though the worker has not lost any time from work, if there are permanent residuals of the accident or disease.
Death benefits may also be awarded to the family of a worker where the injury or disease results in his or her death. These benefits include funeral expense and weekly indemnity awards.
Steps to Make a Claim
- Report the accident to your supervisor/ employer as soon as possible.
- Seek medical treatment for your injuries immediately, and tell your doctor that your injury is work related.
- Note the exact location of your accident.
- Obtain the names and addresses of all witnesses, if any.
- Don't speak to anyone else about your claim, except your doctor.
